Refund, Return & Plant Acceptance Policy
Earth People LandCare | Plant People
Effective October 8, 2026
At Earth People LandCare, we take pride in delivering quality plants and trees that have been carefully selected and inspected before delivery.
Because plants are living, perishable products whose health can change rapidly due to environmental conditions and handling, we maintain the following return and refund policy.
PLEASE READ BEFORE ORDERING: All live plant and tree sales are final upon delivery, inspection, and acceptance, except where a remedy is required by applicable law or expressly provided in a separate written agreement.
1. Live Plants & Trees — Final Sale
All living plant material, including fruit trees, citrus, avocados, California native plants, ornamental plants, shrubs, vines, specimen trees, and specialty nursery stock, is sold under a final-sale policy.
Once plants have been delivered, inspected, and accepted by the customer or their authorized representative:
-
No returns for changes of mind or personal preference.
-
No exchanges solely because a customer prefers a different variety, size, or appearance after accepting the correctly supplied plant.
-
No refunds solely because plants subsequently experience transplant shock, leaf drop, environmental stress, or decline caused by post-delivery conditions.
-
No voluntary replacement guarantee unless expressly included in a separate written agreement.
These limitations do not apply where a refund, replacement, or other remedy is required by law.
2. Plant Inspection Before Delivery
Earth People LandCare inspects plants before delivery for visible indicators of plant quality, health, pest activity, and physical damage.
Inspection may include examination of foliage, branching, trunk condition, root-ball stability where accessible, and general plant vigor.
Plant inspections are visual and practical assessments, not laboratory disease testing or guarantees that hidden or latent conditions are absent.
Natural variations in foliage, size, seasonal appearance, growth habit, and branching are normal characteristics of living plants.
3. Delivery Inspection & Customer Acceptance
Customers or their authorized representatives should inspect plant material upon delivery and before installation when reasonably practical.
Customers should confirm:
-
Correct variety and quantity
-
Agreed container size
-
General visible condition
-
Visible transportation damage
-
Significant discrepancies from the confirmed order
When practical, Earth People LandCare may document delivery and visible plant condition using photographs, delivery records, and customer acknowledgment.
Acceptance occurs when the customer or authorized representative approves the delivered plant material, whether documented by signature, electronic acknowledgment, or other reliable evidence of acceptance.
If a customer is unavailable, we will follow the previously agreed delivery instructions. Proof of delivery alone does not automatically establish that the customer inspected or accepted the plant.
Acceptance confirms approval of the delivered material's reasonably observable condition. It does not waive legal rights relating to hidden defects, incorrect goods, or other non-excludable consumer protections.
4. Reporting Damage or Incorrect Orders
If a plant arrives visibly damaged, is materially different from its description, or does not match the confirmed order, customers should notify us immediately.
We request that visible delivery-related issues be reported within 24 hours whenever reasonably possible.
Please provide the order number, photographs, and a description of the concern.
Earth People LandCare will review the delivery record, supplier information, and available evidence to determine an appropriate resolution.
The 24-hour reporting request helps us investigate claims but does not limit statutory consumer rights or remedies.
5. Plant Health After Delivery
Once accepted, living plants may be affected by conditions beyond our control, including:
-
Improper watering or irrigation failure
-
Poor soil drainage or waterlogged conditions
-
Extreme temperatures, wind, or sun exposure
-
Improper planting depth or root disturbance
-
Fertilizer misuse or chemical exposure
-
Pest infestations and disease exposure
-
Damage from animals, landscaping equipment, or third parties
-
Failure to plant promptly or follow reasonable care recommendations
We do not offer a voluntary survival guarantee covering losses caused by these post-delivery conditions.
Customers purchasing delivery without installation are responsible for timely planting, appropriate placement, irrigation, and ongoing care.
Our team may offer assistance with diagnosis, corrective treatments, and ongoing care as separate services.
6. Citrus Trees & HLB
Citrus trees face additional risks associated with Huanglongbing (HLB), also known as citrus greening, and other diseases or pests.
Citrus products are inspected before delivery and transported in accordance with applicable California plant movement requirements.
We do not offer a voluntary post-delivery citrus survival, growth, or disease-free warranty.
This does not exclude legally required remedies for plants that were defective, incorrectly described, or otherwise failed to meet applicable legal requirements when supplied.
7. Professional Installation
Professional planting and installation services are separate from plant purchases unless expressly included in the order.
When installation is purchased, customers should review the completed work and report any visible concerns promptly.
Plant installation does not automatically include a plant-survival or replacement warranty.
Any workmanship warranty, establishment-care agreement, or replacement coverage must be expressly stated in a separate written agreement.
Installation-related concerns will be reviewed according to the applicable service agreement and California law, including any mandatory contractor warranty or correction obligations.
8. Special Orders & Large Specimen Trees
Special-order plants, uncommon varieties, and mature specimen trees may be acquired specifically for an individual customer.
Examples include 24-inch, 36-inch, and 48-inch boxed trees and custom nursery orders.
Before a special order is placed with a supplier, we will communicate applicable cancellation terms, deposits, and any nonrecoverable supplier or transportation expenses.
Once a special order has been committed to the supplier, cancellation may involve reasonable, previously disclosed, and legally permissible charges.
Any nonrefundable deposit or special-order charge must be expressly disclosed and agreed to before payment.
If we cannot provide the item as agreed, we will offer an appropriate alternative or cancellation and any refund required by applicable law.
9. Orders Not Yet Delivered
Customers wishing to cancel an order should contact us as soon as possible.
For orders that have not yet been committed to a supplier, dispatched, or specially prepared, we will review cancellation requests and provide applicable refunds.
Orders involving supplier commitments, custom handling, or delivery costs already incurred may be subject to previously disclosed cancellation charges where legally permitted.
We do not impose undisclosed fees or retain payments in violation of applicable law.
10. Refunds, Replacements & Disputes
If Earth People LandCare determines that a refund or replacement is appropriate, or one is required by law, we will communicate the resolution directly.
Approved refunds will generally be issued to the original payment method.
Refund processing times may depend on the payment provider and financial institution.
We may request reasonable supporting information, including delivery photos, order details, and a description of the issue, to evaluate a claim. These requests do not eliminate legally required remedies.
11. No Public Nursery Returns
Earth People LandCare operates as an online ordering, local delivery, and professional installation business.
We do not operate a public retail nursery or customer pickup and returns counter.
Do not bring plants or other merchandise to any internal storage or fulfillment address.
All return inquiries, damage reports, and refund requests must be coordinated directly with Earth People LandCare.
12. Applicable Consumer Rights
Nothing in this policy limits or excludes any consumer rights, implied warranties, remedies, or protections that cannot legally be waived.
If any provision conflicts with applicable law, that law will control.
